Trial: In legal parlance, a trial
is an event in which parties to a dispute present information
(in the form of evidence) in a formal setting, usually a court,
before a judge, jury, or other designated finder of fact, in order
to achieve a resolution to their dispute. |
Legal Dispute: A legal controversy
or case
in which parties actively argue, disagree or debate over matters
of law, or the application of the law to the controversy. |
Arbitration:
Arbitration
is a legal technique for the resolution of disputes outside the
courts, wherein the parties to a dispute refer it to one or more
persons (the "arbitrators" or "arbitral tribunal"),
by whose decision (the "award") they agree to be bound.
Arbitration is today most commonly used for the resolution
of commercial disputes, particularly in the context of international
commercial transactions. It is also used in some countries to
resolve other types of disputes, such as labour disputes, consumer
disputes or family disputes, and for the resolution of certain
disputes between states and between investors and states. |
Mediation: Mediation
comprises an act of bringing two states, sides or parties in a
dispute closer together toward agreement through alternative dispute
resolution (ADR), a dialogue in which a (generally) neutral third
party, the mediator, using appropriate techniques, assists two
or more parties to help them negotiate an agreement, with concrete
effects, on a matter of common interest. More generally speaking,
the term "mediation" covers any activity in which an
impartial third party (often a professional) facilitates an agreement
on any matter in the common interest of the parties involved. |
