Case-Notes: In ARAVE, WARDEN v. HOFFMAN, MAXWELL the Supreme Court entered a per curiam order in favor of Respondent Maxwell Hoffman. He was convicted of first-degree murder and sentenced to death. See State v. Hoffman, 123 Idaho 638, 851 P. 2d 934 (1993). Hoffman sought federal habeas relief on the grounds that, inter alia, his counsel had been ineffective during both pretrial plea bargaining and the sentencing phase of his trial. After abandoning his claim that his counsel was ineffective during plea bargaining the State agreed to withdraw its petition to the Supreme Court, so that he may proceed with the resentencing ordered by the District Court.

Sunday, December 3, 2006 - WASHINGTON - Justice Stephen G. Breyer says the Supreme Court must promote the political rights of minorities and look beyond the Constitution's text when necessary to ensure that "no one gets too powerful." Justice Breyer, a Clinton appointee, has brokered many of the Supreme Curt's 5-4 rulings. Breyer spoke in a televised interview on "Fox News Sunday", that aired one day before the justices will hear a key case on race in schools. Breyer said judges must consider the practical impact of a decision to ensure democratic participation. Wednesday - November 8, 2006 - WASHINGTON - The graphic details of a disputed abortion procedure filled the Supreme Court on Wednesday as justices voiced concern with a federal ban on that operation. In an intense morning of oral argument, Bush administration lawyers and abortion rights supporters gave their contrasting views on the abortion practice.
A Term of the United States Supreme Court begins, by statute, on the first Monday in October. Usually Court sessions continue until late June or early July. The Term is divided between “sittings,” when the Justices hear cases and deliver opinions, and intervening “recesses,” when they consider the business before the Court and write opinions. Sittings and recesses alternate at approximately two-week intervals. With rare exceptions, each side is allowed 30 minutes argument and up to 24 cases may be argued at one sitting. Since the majority of cases involve the review of a decision of some other court, there is no jury and no witnesses are heard. For each case, the Court has before it a record of prior proceedings and printed briefs containing the arguments of each side.
